Prosecutors allege Soules attempted to

"Chris may be subjected to a Class D felony, which is the lowest class of felony in Iowa and faces up to a 5 year prison term for fleeing the scene of a fatal vehicle accident".

In the documents, it stated that Soules' level of intoxication could not be determined and the 35-year-old reality star failed to explain the alcohol bottles in his vehicle.

That information was included in the Buchanan County Attorney's Office response to Soules' request to have his criminal case dismissed.

Authorities say he left the scene after his truck rear-ended a man on a tractor last week.

As of right now, it's unclear if the prosecution has video evidence of Chris purchasing alcohol or if they only have an eyewitness.

In a motion filed Tuesday, Buchanan County Attorney Shawn Harden agreed that Chris Soules didn't attempt to hide his identity following the crash. As we previously reported, Mr. Soules is now trying to have the felony charge for the fatal accident he was involved in dismissed as the reality TV vet supposedly did "everything right" following the crash.

Soules' lawyers filed a motion to dismiss the charge against him on Monday.

In previous court documents, the police noted that there were alcoholic beverages found at the crash scene.

"Mr. Soules described the location of the accident and communicated with dispatch for approximately 5 minutes and 45 seconds while help was en route".

Buchanan County Sheriff Bill Wolfgram said last week that when deputies arrived at Soules' Fayette County home to talk to him about the crash, he refused to cooperate.

"The evidence will further show that emergency responders arrived on the scene shortly after Mr. Soules concluded his 911 call".

According to KCCI, state prosecutors are arguing against a dismissal of charges due to the court already determining "that there is probable cause to believe that an offense has been committed and the defendant committed it".

Chief District Court Judge Kellyann M. Lekar was assigned Soules' case Monday on a "preliminary basis", according to court documents.

Soules is a longtime resident of Arlington, IA, where his family owns and operates a farm.
